FXTM富拓：牛年有礼（天猫超市礼品卡）活动条款和条件

1、INTRODUCTION

引言

1.1 FXTM[1] is running the New Year Gift (Tmall supermarket shopping card) Promotion (the “Promotion”) which is applicable to selected clients at FXTM’s discretion, excluding clients assigned under IB & Affiliates.  By participating in this Promotion, you agree to be bound by the Terms and Conditions herein (hereinafter referred to as the “Terms”) as these are set out below.

本牛年有礼（天猫超市礼品卡）活动（以下简称“赠礼活动”）适用于由FXTM富拓决定的特选客户（代理商及网络联盟商名下的客户除外）。参加本次赠礼活动即表示您同意受以下条款和条件的约束（下简称“条款”）。

1.2 This Promotion Period shall run from the 1st February 2021 (00:01) to the 15th February 2021 (23:59) (Beijing time) inclusive (the “Promotion Period”).

活动期由北京时间2021年2月1日0点01分开始至2月15日23点59分止（以下简称“活动期”）。

1.3  A client who participates in this Promotion shall receive the “Benefit” as defined in accordance with clause 4 of this Promotion and subject to the Terms and Conditions herein.

参加本次活动的客户有机会获得根据本次活动条款4及其他条款和条件所规定的“赠礼”。

2、ELIGIBLE CRITERIA

资格标准

2.1 To participate in this Promotion, you must meet the following requirements:

为参加本次活动，您须满足以下条件：

a) You are a newly registered client of FXTM, or an existing Client of FXTM without any deposit record before; deposited during the Promotion Period and traded by the 28th February 2021.

您是FXTM全新客户，或已开立账户但从未有过任何入金记录；在活动期间入金及在2021年2月28日前完成交易量要求进行交易

b) Run a live trading account with FXTM as per the applicable Deposit and/or other requirements of FXTM[2]

根据适用的存款和/或FXTM的其他要求，在FXTM操作真实交易账户

c) Read and Accept the Terms of this Promotion;

阅读并同意本活动条款

d) Make a Deposit in the Account during the Promotion Period, following b) and c) above.

在促销期间，按照上述b）和c）在账户中存款。

2.2 The Promotion shall only be available to each client at the discretion of FXTM to offer the Benefit and shall be given to the client after receipt of the client’s acceptance of these terms and conditions.

本活动由FXTM富拓自行决定在客户接受本条款和条件后给予赠礼。

2.3 Acceptance of these terms and conditions must be express, in writing, and communicated from the client to FXTM via email (the “Acceptance”).

客户必须以书面形式明确表示接受本条款和条件并通过电子邮件传达给FXTM富拓(以下简称“接受”)。

3、TRADING TERMS

交易条款

3.1 The Promotion is applicable to all account types.

本赠礼活动适用于所有账户类型。FXTM富拓可自主调整，无需提前通知。

3.2 Each client is to receive the Benefit only once during the Promotion Period.

每位客户在本次活动期间仅能获得一次赠礼。

3.3 Eligible trade is applicable to all CFDs (excluding CFDs on shares), Forex, precious metals and commodity futures. One qualifying trade refers to a complete round trip of opening and closing a position. Only positions that were opened and closed during the Program period, provided that they were open for more than 5 minutes.

合资格的交易适用于所有 CFD（不包括股票 CFD）、外汇、贵金属和商品期货。一手合资格交易指开仓、平仓一个来回的完整交易。只有活动期中开仓和平仓且开仓时间超过 5 分钟的交易才会被计入交易手数。

3.4 Irrespective of the number of trading accounts that may be opened by a new and approved client with FXTM, the Benefit shall only be applicable to the client’s trading account approved by FXTM (the “Account”).

不论FXTM富拓的新老客户开设了多少个交易账户，本活动仅适用于获得富拓批准的客户交易账户（以下简称“账户”）。

4、SPECIFIC PROMOTION TERMS

特别活动条款

4.1 The gift value of Tmall supermarket shopping card (the “Benefit”) is based on the Total Deposit (“Total Deposit”) during the Promotion Period and Total Trading Amount (“Total Trading Amount”) by 31 Mar 2021 of the client in accordance with the table below made by the client in the Account after the Acceptance of these Terms and Conditions.

客户接受本条款和条件后，在活动期内满足账户中存入总金额（以下简称“总入金金额”）的要求，及在2021年2月28日前满足交易的总交易量（以下简称“总交易量” ）要求后，可获得天猫超市礼品卡赠礼（以下简称“赠礼”）面值按以下相对应列表而定。

*One qualifying trade refers to a complete round trip of opening and closing a position.

*一手合资格交易指开仓、平仓一个来回的完整交易。

4.2 The Benefit will be cancelled in the case where the client withdraws any amounts of funds  on or before the 31st of March 2021 after the Acceptance of these Terms and Conditions.

如客户接受本条款和条件后，不可于在2021年3月31日或之前提取任何数量的资金，则赠礼将被取消。

4.3 The client should provide their mailing address and telephone number on or before the 31st of March 2021 by email to chinese@fxtm.com. The Benefit shall be delivered to Client’s designated address on or before the 15th of April 2021 subject to clauses 4.1 and 4.2. FXTM will not be responsible for any delay whatsoever where the client fails to confirm the mailing address and telephone number in a timely manner.

客户需于2021年3月31日或之前电邮发送至chinese@fxtm.com提供、确认邮寄地址及联络电话。客户如满足4.1及4.2，将于2021年4月15日或之前收到赠礼。如因为客户未能及时确认邮寄地址、电话而造成任何延迟，富拓将不承担责任。

4.4 If the Client made several deposits, the Benefit shall be calculated in accordance to the amount of the Total Deposit as defined in clause 4.1 herein.

所有于活动期内符合本条款和条件的入金均对获得赠礼有效。如客户注资多次，则赠礼数额将根据以上条款4.1中所规定的总入金金额来计算。

4.5 The Benefit is non-transferable, non-cash-back.

赠礼不可转让，不可返现。

4.6 FXTM shall not be liable for any margin call or losses that the client may suffer, including but not limited to losses due to Stop-out Level, as a reason of or during this Promotion Period.

根据本条款和条件， FXTM富拓将对客户可能由于本次活动或在本次活动期间所遭受的追加保证金或损失，包括但不限于因强制平仓造成的损失不承担责任。

4.7 FXTM has the right to withdraw without prior notice the Benefit gained if:

若出现下列情况，FXTM富拓有权撤销赠礼，无需提前通知：

a）  a breach of these Terms and Conditions occurs;

违反本条款和条件；

b)   FXTM has reasonably grounds to believe a misuse of the Promotion;

FXTM富拓有合理的理由相信活动被滥用；

c)  The Client acts in bad faith and/or abusively and/or fraudulently and/or in a manner that is not in line with this Promotion and applicable Terms.

客户不诚实和/或滥用和/或欺诈和/或以不符合本促销和适用条款的方式行事。 

4.8 During the Promotion Period the client cannot participate in any other promotion announced by FXTM except for Loyalty Program and Referral Program.

在活动期内，客户不能参加FXTM富拓举办的的任何其他优惠活动，FXTM富拓忠诚度项目优惠活动除外。

5、MISCELLANEOUS

其他事项

5.1 FXTM reserves the right, as it in its sole discretion deems fit, to alter, amend, suspend, cancel or terminate the Promotion. In the event of modifying the conditions, FXTM shall give such notice to the client as may be required by applicable legislation. Under no circumstances shall FXTM be liable for any consequences of any alteration, amendment, suspension, cancelation or termination of the Promotion.

FXTM富拓保留在自由裁量认为适当的情况下变更、 修正、中止、取消或终止本次活动的权利，富拓应根据适用法律的要求向客户发出通知。在任何情况下， 富拓不对由于活动的更改、修正、中止、取消或终止造成的任何结果负有责任。

5.2 Any indication or suspicion of fraud, manipulation, cash-back or bonus or swap arbitrage, or other forms of deceitful or fraudulent activity in a client’s account or multiple account with FXTM or otherwise related or connected to the Benefit shall nullify any and all transactions carried and/or profits or losses garnered therein.

若有任何迹象或FXTM富拓怀疑客户账户或多个账户或其他与赠礼相关的账户中存在欺诈、操控、返现或奖金或互换套利或其他形式的欺骗或欺诈活动，所有已执行的交易和/或由此产生的利润或亏损均无效。

5.3 FXTM reserves the right, at its sole discretion, to disqualify any individual that FXTM suspects misuses or attempts to misuse the Benefit, or breaches the present Terms and Conditions and/or any of FXTM’s Business Terms and to cancel all orders and annul all profits of such client. If FXTM, in its sole discretion, suspects any Benefit arbitrage or any misuse or attempts to misuse the Benefit, and the client has open positions, FXTM reserve the right to withdraw the Benefit. In these circumstances, FXTM shall not be liable for any consequences of the Benefitcancelation.

FXTM富拓保留，在其自由裁量情况下，取消滥用或试图滥用本赠礼活动、违反本条款和条件和/或FXTM富拓任何商业条款的客户参加活动的权利，取消此类客户所有定单和所有利润。如果FXTM富拓怀疑客户有任何赠礼套利或任何滥用或试图滥用赠礼活动的行为且客户已建仓，FXTM富拓保留撤回赠礼的权利。在这些情况下。FXTM富拓不负责由于赠礼取消造成的任何后果。

5.4 Notwithstanding the translated language of this document, the English wording shall be the binding version in the event of any discrepancy between the two languages.

无论本文件的翻译语言的情况如何，在出现两种语言的任何不符的情况下，均以英语版本为准。

An FXTM client agrees to the Terms and Conditions of this Promotion and makes a Deposit and trades below.

FXTM富拓的一位客户接受本活动条款和条件后入金及交易如下。

During the Promotion, the Total Deposit is 3,000 USD and Total Trading Amount is 10 lots. The client doesn’t withdraw any funds as of the 31th March 2021. The client will receive the Benefit of ￥1,000 gift value of Tmall supermarket shopping card on or before the 15th April 2021.

客户于赠礼活动内共入金3,000美元及交易10手。客户于2021年3月31日为止都没有提取资金。客户将于2021年4月15日或之前收到￥1,000面值天猫超市礼品卡。
